By creating an account, accessing, or using Obel, you agree to these Terms. Obel is a personal legacy communication service. It is not a legal will, estate planning, trust, financial instruction, or emergency response service.

2. Account and Eligibility

You must be legally able to enter into a binding agreement to use Obel. You are responsible for maintaining accurate account information, securing your login credentials, and all activity under your account.

3. Your Content and Conduct

You retain ownership of the messages you create, but you are solely responsible for their content, legality, and timing. You agree not to use Obel for illegal, harassing, threatening, defamatory, or spam purposes. We reserve the right to remove content or suspend accounts that violate these terms.

4. Inactivity-Based Delivery

Obel relies on your chosen inactivity window to trigger message delivery. We use account activity signals to monitor this window. We do not make official, legal, or medical determinations of life events. Technical circumstances may affect delivery, so you remain responsible for periodically reviewing your settings.

5. Disclaimers and Limitations of Liability

• No Guarantee: The service is provided "as is" and "as available". We do not guarantee that messages will be delivered at an exact time, without delay, or error-free. Do not rely on Obel for emergency, legal, or critical matters.
• Limitation of Liability: To the maximum extent permitted by law, Obel disclaims all warranties. In no event shall Obel be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the past 12 months, or $50.
• Indemnity: You agree to defend and hold Obel harmless against claims arising from your use of the service or your hosted content.

6. Privacy and Account Deletion

Your data is handled according to our Privacy Policy. You can request account and data deletion at any time in the app settings or by contacting support.

7. Intellectual Property

We retain all ownership of the Obel service and its designs. It is provided to you under a limited, personal, non-exclusive license. You grant us the right to use any feedback you provide without restriction.

8. Changes and Termination

We may modify, suspend, or discontinue parts of the service at any time. Paid features, if introduced, will be subject to additional presented terms. We may also terminate or suspend your access if you violate these Terms.

9. Governing Law

These terms are governed by the laws of the State of New York. Any disputes will be resolved exclusively in the state or federal courts in New York County, New York.

10. Apple App Store Terms

If accessing Obel via an Apple device, these terms are between you and Obel, not Apple. Apple provides no warranties, maintenance, or support for the app, but is a third-party beneficiary of these terms and may enforce them.
